Digital Millennium Copyright Act (DMCA) Notice

Reporting Claims of Copyright Infringement
At Spicy Visuals, we take copyright infringement seriously. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) or any other applicable intellectual property laws. Responses may include removing or disabling access to the infringing material, and/or terminating the user’s account.
If you believe that any content (including images or videos) on Spicy Visuals infringes your copyright, you may submit a DMCA notice (see below, “Filing a DMCA Notice of Copyright Infringement”). These requests should only be submitted by the copyright owner or an agent authorized to act on the copyright owner’s behalf.
If we remove or disable access to material following a DMCA notice, we will notify the user responsible for uploading the content so they can file a counter-notification if they believe the content was removed in error (see below, “Counter-Notification Procedures”).
All DMCA notices and counter-notifications must be in English. Notices not in compliance with these requirements may be disregarded at our discretion.
Filing a DMCA Notice of Copyright Infringement
If you wish to request the removal of content by submitting a DMCA notice, you are initiating a legal process. Please do not make false claims. Misuse of this process may lead to account suspension or legal consequences.
To submit a copyright infringement notice, send us an email at copyright@spicyvisuals.com with the following information:
Identification of the copyrighted work: Clearly identify the work you claim has been infringed. If the claim involves multiple works, you may submit a representative list of such works.
Identification of the infringing material: Provide specific URLs of the exact content (image or video) that you claim is infringing. General descriptions like channel URLs or usernames are not sufficient.
Your contact information: Include your full name, postal address, phone number, and email address.
Good faith statement: Include a statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
Accuracy statement: Include a statement that the information provided is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf.
Signature: Include your physical or electronic signature. For electronic submissions, you may type your full legal name.

Please note: The information provided in your DMCA notice (including personal information) may be forwarded to the uploader of the content and may be part of the public record.
If your DMCA Notice fails to comply with all the above requirements, it may not be effective.
Counter-Notification Procedures
If you believe that material you uploaded was mistakenly removed or disabled due to a copyright infringement notice, you can file a Counter-Notification. Counter-notices must be submitted by the original uploader or an authorized agent.
To file a counter-notification, please send an email to copyright@spicyvisuals.com with the following details:
Your contact information: Include your full name, address, phone number, and email.
Identification of the removed material: Provide the specific URLs of the content that was removed or disabled and its location before it was removed.
Good faith statement: Include a statement, under penalty of perjury, that you believe in good faith that the material was removed as a result of mistake or misidentification.
Consent to jurisdiction: A statement that you consent to the jurisdiction of the U.S. federal courts in your location, or if you’re outside the U.S., to any judicial district where Spicy Visuals may be found.
Signature: Include your physical or electronic signature. For electronic submissions, you may type your full legal name.
Once we receive your counter-notification, we will forward it to the party who filed the original DMCA Notice. If they do not take legal action within 10-14 business days, the material may be restored.
Please note: When we forward your Counter-Notice, it will include your personal information. By submitting a counter-notification, you consent to having this information shared with the original claimant.
Repeat Infringers
In compliance with the DMCA, we have adopted a policy to terminate or disable accounts of users who are deemed repeat infringers. We may also restrict access to our services or terminate any accounts that infringe the intellectual property rights of others, regardless of repeat violations.
Video Fingerprinting
To protect copyright owners, Spicy Visuals may use digital fingerprinting technology to help identify and block infringing content from being uploaded. If you believe your content has been uploaded without permission and wish to have it digitally fingerprinted for protection, please contact us at copyright@spicyvisuals.com for more information.
